1. General Terms and Conditions of the association "Unsere Oper e.V."
1.1 These General Terms and Conditions apply to all services of the association "Unsere Oper e.V." in connection with the reservation, sale, and delivery of tickets (hereinafter referred to as "Tickets") as well as vouchers for tickets via the website www.immling.de (hereinafter referred to as "Festival Website") as well as by telephone order through the telephone service of "Unsere Oper e.V."
1.2 By reserving or purchasing tickets or vouchers via the Festival Website or the telephone service of "Unsere Oper e.V.", the customer acknowledges the validity of these General Terms and Conditions.
2. Provisions for the use of the Festival Website and the telephone service
2.1 The offer of the association "Unsere Oper e.V." is exclusively directed at adults who are not restricted in their legal capacity.
2.2 The customer assures that all data provided by him is true and complete and that he is entitled to dispose of the bank account or credit card specified during the ordering process.
3. Restriction of private and prohibition of commercial resale
3.1 The commercial resale of tickets and vouchers for specific performances named on the vouchers is prohibited.
3.2 Tickets may not be sold privately for a higher price than the printed ticket price plus proven fees that were charged when purchasing the tickets. Tickets and vouchers for specific performances named on the vouchers may also not be sold privately through internet auction houses or internet ticket exchanges.
3.3 "Unsere Oper e.V." reserves the right to block access to the use of the Festival Website or to refuse ticket requests if "Unsere Oper e.V." has reasonable suspicion that the provisions mentioned in section 3) are being violated.
4. Conclusion of contract and payment
4.1 The ticket offer on the Festival Website is an invitation to the customer to make a purchase or reservation offer. The customer makes an offer for a contract conclusion for the purchase of tickets by clicking the "order with payment obligation" button on the fully and truthfully completed order form. The customer is bound to his offer for 4 working days after receipt by "Unsere Oper e.V.". "Unsere Oper e.V." confirms the receipt of the offer by email. A valid contract has not yet come into existence.
4.2 A contract is only concluded when "Unsere Oper e.V." confirms the order in electronic or text form within 4 working days after receipt of the order by "Unsere Oper e.V." to the customer.
4.3 a) If the customer only reserves tickets (only possible within the framework of the telephone service), this is a non-binding reservation of the customer's interest in purchasing tickets for him and "Unsere Oper e.V.". "Unsere Oper e.V." will not accept reservations from other customers for the reserved tickets during the reservation period and will not sell the reserved tickets to third parties.
- b) A contract for the reservation of tickets is only concluded with the customer's declaration in electronic form or in text form that he wishes to purchase the reserved tickets bindingly during the reservation period and this purchase offer has been accepted by "Unsere Oper e.V." electronically or in text form. The reservation period ends, unless otherwise expressly agreed, 14 days before the performance date, without the need for a special declaration.
4.4. The purchase price for the tickets is due immediately upon conclusion of the contract. Payment is made, unless expressly agreed otherwise, by direct debit within the framework of a SEPA mandate. Cash payment is also possible when picking up the tickets. Payment by credit card is possible when booking in our webshop.
5. Right of withdrawal and sample withdrawal form
There is no right of withdrawal for consumers in contracts for the provision of services in connection with leisure activities if the contract provides for a specific date or period for the provision (§ 312g Abs. 2 Satz 1 Nr. 9 BGB). This means that as far as "Unsere Oper e.V." offers services in the field of leisure activities, especially tickets for events, there is no right of withdrawal. Each order of tickets is therefore binding immediately after confirmation by "Unsere Oper e.V." and obliges to accept and pay for the ordered tickets.
However, you have a right of withdrawal and return when purchasing vouchers and goods in accordance with the statutory provisions if you are a consumer as our customer. We are obliged to inform you about this right of withdrawal when purchasing vouchers and goods (hereinafter referred to as "goods"):

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.

with a clear statement (e.g. a letter sent by post, fax, or email) about your decision to withdraw from this contract. You may use the sample withdrawal form below, but it is not mandatory.
To comply with the withdrawal period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the withdrawal period expires.
Consequences of withdrawal
If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (except for the additional costs resulting from your choice of a different type of delivery than the least expensive standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this refund, we will use the same payment method that you used for the original transaction, unless something else has been expressly agreed with you; in no case will you be charged fees for this refund. We may withhold the refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier.
You must return the goods to us without delay and in any case no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired. You bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary for checking their nature, characteristics, and functioning.

End of the withdrawal instruction
In the event of withdrawal by the customer, the following applies:
"Unsere Oper e.V." may refuse the refund until "Unsere Oper e.V." has received the goods back or until the customer has provided evidence that he has returned the goods, whichever is earlier.
The customer must return the goods to "Unsere Oper e.V." without delay and in any case no later than fourteen days from the day on which he informs "Unsere Oper e.V." of the withdrawal from this contract. The deadline is met if the customer sends the goods before the fourteen-day period has expired. The customer bears the direct costs of returning the goods. The customer must pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary for checking their nature, characteristics, and functioning.
6. Customer's duty to examine
Immediately after receipt of the purchase or reservation confirmation and after receipt of the tickets, the customer is obliged to check the confirmations and the delivered tickets for correctness (event, date/time of the event, venue, and number of tickets).
In case of discrepancies or errors, the customer is obliged to inform "Unsere Oper e.V." immediately in text form (by email to the address tickets@immling.de or by fax to +49 8055 90 34-28).
"Unsere Oper e.V." will then make every effort to clarify the inaccuracies and provide the customer access to the agreed event. If this is not possible (e.g. the event is sold out in the meantime), the customer will receive a refund of the purchase price. Further claims by the customer are excluded.
7. Shipping of tickets, pickup
7.1 Tickets will be sent to the address specified by the customer at the time of ordering upon request.
7.2. Shipping is done by post at the customer's expense and risk. "Unsere Oper e.V." reserves the right to choose other established shipping companies in the market at its discretion in addition to Deutsche Post AG.
7.3 "Unsere Oper e.V." assumes no liability for the timely delivery of the tickets.
7.4 "Unsere Oper e.V." is not obliged to replace lost or destroyed tickets or to refund the purchase price.
7.5 Tickets can be picked up during the announced office hours at the Festspielbüro Immling or before the event at the box office no later than half an hour before the start of the event.
8. Start / Admission / Seat; Changes
8.1 The festival venues are usually opened about 30 minutes before the start of the performance. After the performance has started, ticket holders may only be admitted to the auditorium during a suitable break, taking into account the participating artists and other visitors. There is no entitlement to a break.
8.2 Limited seating is available for wheelchair users. They are only entitled to a wheelchair-accessible seat if they have indicated at the time of purchasing the ticket that they require such a seat.
8.3 "Unsere Oper e.V." reserves the right to assign the ticket holder a different seat than the one assigned on the ticket for the respective event if it is not possible for "Unsere Oper e.V." to provide the seat indicated on the ticket for reasons beyond its control (e.g. construction work) and the substitute seat assigned is comparable. Otherwise, the ticket holder is entitled to a refund of the difference to the price indicated on the ticket.
9. Audio, photo, and film recordings
Audio, photo, and film recordings are prohibited in the theater for copyright reasons. Recording devices and cameras of all kinds may not be taken into the auditorium.
10. Disclaimer
The liability of "Unsere Oper e.V." is limited to cases of intentional or grossly negligent breach of duty and is otherwise excluded. The statutory liability in the event of negligent injury to life, body, or health remains unaffected. "Unsere Oper e.V.", its legal representatives, and its vicarious agents are only liable in cases of intent or gross negligence. In the event of a breach of essential contractual obligations, liability also exists in cases of simple negligence, but limited to the foreseeable, contract-typical damage. Claims for damages arising from injury to life, body, or health as well as under the Product Liability Act remain unaffected by the above limitations.
11. Cancellation of events
In the event of the cancellation of the event, "Unsere Oper e.V." will refund the ticket price paid by the customer. Further claims do not exist.
12. House rules, behavior in the theater
12.1 The behavioral rules contained in these GTC and the instructions of the security personnel must be observed.
12.2 Smoking in the theater premises is prohibited. Objects that are likely to disturb the performance (e.g. mobile phones, electronic watches) must be turned off before the performance begins.
13. Place of performance and applicable law, jurisdiction
13.1 The law of the Federal Republic of Germany applies exclusively. The sole place of performance for deliveries, services, and payments is Gut Immling, provided the customer is an entrepreneur within the meaning of § 14 BGB.
13.2 If the customer is a merchant, Halfing is agreed as the place of jurisdiction for all disputes arising from the contractual relationship; "Unsere Oper e.V." reserves the right to call any other civil court with jurisdiction.
